Once you file for bankruptcy, you'll have plenty of questions. One of the first questions you might have is how filing for bankruptcy will affect your job status.

In many cases, you cannot lose your job just because of filing for bankruptcy. It is against federal law for a public or private employer to fire or demote an employee who has filed for bankruptcy. Because it is federal law, it applies in Connecticut and all other states.

The situation can be different for a person searching for a job. The filing for bankruptcy can impact credit, and credit scores can be part of background checks. Many businesses will run a background check on job candidates. The degree of impact on the potential employee may depend on the job position. A bankruptcy filing could have a greater impact on a person applying for a job in the financial or accounting field. The credit report may likely be a part of the pre-employment background check if a person is applying for such a job, or just a job that deals with money or a budget. This can mean jobs in the area of payroll, cashier, bookkeeping or accounting. It is worth noting that some states, including Connecticut, have laws that put restrictions on how employers check credit reports.

Your employer may not necessarily find out about your bankruptcy filing. However, this will certainly not be the case if your wages are to be garnished by a creditor. If this is the case, your employee will receive a notice of wage garnishment.
